The Trusts Act, 1882 With Punjab Trusts Act, 2020 — Bare Act (As Amended Upto Date)
By Salman Mansoor, Advocate Supreme Court
Trust law in Pakistan underwent a major transformation in 2020, and this edition brings together both the historic framework and its modern replacement — The Trusts Act, 1882 and The Punjab Trusts Act, 2020 — in a single volume, compiled by Salman Mansoor, Advocate Supreme Court, and published by Mansoor Law Book House.
Why This Compilation is Essential
The Trusts Act, 1882 was, for over a century, Pakistan's foundational statute governing the creation, administration, and regulation of private trusts. In 2020, however, Punjab repealed the 1882 Act and enacted the Punjab Trusts Act, 2020 in its place, responding to Financial Action Task Force recommendations on money laundering and terrorist financing risks associated with trusts and waqfs. The new law introduced mandatory registration of all trusts, stricter trustee duties, and enhanced oversight and audit mechanisms — and was itself further refined by the Punjab Trusts (Amendment) Act, 2022. Because trusts created or registered under the old law needed fresh registration under the new Act, and because the 1882 Act's core principles on trustee duties still inform interpretation of the modern statute, having both texts together in one volume is genuinely useful for anyone working through this transition.
